1. Acceptance of terms
By accessing or using the website at https://www.mobileapplicationtesters.com ("Site"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Site.
These Terms govern use of the Site as an informational resource. Separate written Master Services Agreements ("MSA") govern any commercial engagement for mobile app testing or quality assurance services. In the event of conflict between these Terms and an executed MSA, the MSA controls for the subject matter it covers.
We reserve the right to modify these Terms at any time. Material changes will be indicated by an updated "Last updated" date at the top of this page. Your continued use of the Site after any modification constitutes acceptance of the revised Terms.
2. Permitted and prohibited use
You may use the Site for lawful informational purposes including researching our services, submitting enquiries, and accessing published content. You may not:
- Scrape, crawl, or extract data from the Site using automated means without our prior written consent
- Submit false, misleading, or fraudulent information via any form
- Attempt to access any non-public area of the Site or its supporting infrastructure
- Use the Site to transmit any malware, spam, or unsolicited commercial communications
- Reproduce, republish, or redistribute any content from the Site without written permission, except as expressly permitted under Section 4 (Intellectual Property)

All content on this Site, including but not limited to text, graphics, benchmark data, reports, case studies, methodology descriptions, brand assets, and source code, is owned by or licensed to Mobile Application Testers and is protected by United States and international intellectual property laws.
Permitted use: You may reproduce brief quotations (no more than 150 words) from publicly available Site content for commentary, journalism, or academic research, provided you attribute the source as "Mobile Application Testers (https://www.mobileapplicationtesters.com)" and link to the original page.
Prohibited use: Reproducing full pages, articles, benchmark reports, pricing structures, or methodology documentation for commercial purposes, including competitor intelligence gathering, publication in competing media, or AI training data collection, is expressly prohibited without a separate written licence.
"Mobile Application Testers" and associated logos are trademarks of Mobile Application Testers. Nothing in these Terms grants you a licence to use our trademarks, service marks, or trade dress.
4. Disclaimers and no warranty
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
Benchmark statistics: Performance metrics cited on this Site (e.g., "crash rate reduction of 30–60%", "checkout failure reduction of 15–30%") represent observed outcomes in specific past client engagements and are provided for illustrative purposes only. These figures are not guarantees, projections, or warranties of future performance. Actual outcomes vary based on application architecture, starting quality baseline, scope of engagement, and client implementation of recommendations.
Third-party content: Links to third-party sites, tools, standards documents, and external resources are provided for convenience only. We do not endorse, control, or assume responsibility for third-party content, and we are not liable for any damages resulting from your use of third-party sites.
Uptime: We make reasonable efforts to maintain the Site's availability but do not guarantee uninterrupted access. Scheduled and unscheduled maintenance, hosting infrastructure issues, and circumstances outside our control may result in temporary unavailability.
5. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOBILE APPLICATION TESTERS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THIS SITE OR ITS CONTENT.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE (AS DISTINCT FROM ANY COMMERCIAL SERVICES ENGAGEMENT) SHALL NOT EXCEED ONE HUNDRED US DOLLARS ($100.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
6. Privacy and data
Your use of this Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to data practices described in the Privacy Policy.
Contact form submissions are processed by CompanyHub, a third-party CRM platform. Data submitted via the contact form is governed by our Privacy Policy and CompanyHub's data processing terms. We do not sell or rent your contact information to third parties.
8. User submissions
Any information, material, feedback, or ideas you submit to us via forms, email, or other communication channels ("Submissions") will be treated as non-confidential and non-proprietary unless we have executed a separate Non-Disclosure Agreement (NDA) with you before the Submission.
You grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, and adapt Submissions for any business purpose, including improving our services and content, subject to our Privacy Policy for any personal data contained therein.
You represent that you have the right to make the Submission and that it does not infringe any third-party intellectual property rights or violate any applicable law.
9. Indemnification
You agree to indemnify, defend, and hold harmless Mobile Application Testers and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Site in violation of these Terms
- Your violation of any applicable law or third-party right
- Any content or Submission you provide to us that is false, misleading, or infringes any third-party right
10. Security and responsible disclosure
We implement reasonable security controls to protect this Site and user data. If you discover a security vulnerability, please report it responsibly to us via our contact form before any public disclosure. We commit to:
- Acknowledging responsible disclosure reports within 5 business days
- Working collaboratively to understand and remediate confirmed vulnerabilities
- Not pursuing legal action against good-faith security researchers who comply with responsible disclosure norms
Attempting to exploit, probe, or test vulnerabilities beyond what is necessary to demonstrate the issue, or accessing data belonging to other users, is a violation of these Terms and may violate the Computer Fraud and Abuse Act (CFAA) and other applicable laws.
11. Copyright and DMCA
If you believe that content on this Site infringes your copyright, please submit a written notice to us containing the following information in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512):
- Identification of the copyrighted work you claim has been infringed
- Identification of the allegedly infringing material and its location on the Site (URL)
- Your contact information (name, address, phone number)
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on their behalf
- Your physical or electronic signature
Submit DMCA notices via our contact form, selecting "Legal enquiry" as the subject.
12. Prohibition on AI training use
You may not use any content from this Site, including benchmark data, methodology documentation, case study narratives, pricing structures, and editorial content, for the purpose of training, fine-tuning, evaluating, or developing machine learning models or artificial intelligence systems without our prior written consent.
This prohibition applies regardless of the mechanism used to access content (direct browsing, API access, third-party scrapers, or data aggregation services) and regardless of whether the model or system is for commercial or non-commercial use.
Automated agents (AI crawlers) are directed by our robots.txt file. Accessing content in violation of our robots.txt directives constitutes a breach of these Terms.
13. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to conflict-of-law principles.
Any dispute arising from or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Tarrant County, Texas. You consent to personal jurisdiction in those courts.
Before initiating any formal dispute, both parties agree to attempt good-faith resolution by contacting the other party with a written description of the dispute and their proposed resolution. This informal resolution process shall last no less than 30 days.
If you are a consumer located in the European Union, nothing in these Terms affects your rights under applicable EU consumer protection law, including the right to bring claims in your local courts.
14. Severability and waiver
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving the original intent.
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or of our right to enforce it in the future.
15. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mobile Application Testers regarding your use of this Site, and supersede all prior or contemporaneous understandings and agreements relating to that subject matter.
For commercial service engagements, the executed Master Services Agreement between the parties governs and takes precedence over these Terms with respect to the services and deliverables described therein.
